Because if you use UTF-8 everywhere (http://utf8everywhere.org) you don't need to specify that it is UTF-8. On top of that, "Byte Order Mark" makes no sense in a byte-sized encoding, you could call it an "Encoding Mark" or something like that.

{ ä, ö, ü } are not going to be decoded correctly.
Why the fuck does BOMless UTF-8 still exist? Such a pain in the ass.
