In reality, it means that the police might override a person’s confidentiality and conduct a search when the law enforcement has a plausibility to accept something as true in the case of verification that the suspect perpetrated an offense, and an adjudicator issued an affirmation. The privacy protection in the fourth amendment applies to searching when an individual has a legitimate privacy expectation in the area to be searched. However, the fourth amendment never applies to searches, done by a private guard. Private security outnumbers the police officers in America by one to three. Due to this number, whether working in an office, shopping in a pharmacy or supermarket, or visiting a friend, people are more likely to be confronted by a private security guard than police. This difference exists because the private security guards are considered not to be acting on behalf of the government.
In conclusion, I would like to admit that due to the differences, this structure is not fair and correct for maintaining order while preserving the inherent freedom, protected in America. If the amendment was made, it should apply to both the police and private security personnel. Due to the fact that the law does not include private guards, they might not respect the people’s privacy.
