Yep I think it's more because it's a choking hazard than anything.... But yeah, you can get kinder eggs here but they do not have a toy in the center.

@spongessuck no, @webketje is correct. It's literally because it's food that contain non nutritious objects, which is prohibited by the FDA.
I remember eating some swiss pastry, that contains a little figure, and the saying goes that whoever gets a piece of the pastry with this figure, is denoted as a king for the rest of the day. That food is also illegal in the US. Additionally the company that makes kinder eggs, actually made a variant to sell in the US, where one half is a little container and the other half is the chocolate, where this ban then doesn't apply anymore.
