I mean, to be fair, making the private buyout price be based on a number you thought your girlfriend would find funny is pretty dumb.

@byogdc well, then again, so is sparking up a doobie on a public video stream... I mean, smoke all the herb you want, but don't expect all the world to like it.
Besides, I always suspected musk was gonna turn the Mars into his private Ganja farm. Without gravity, he could easily grow 5 meter christmas trees 😎

Yeah but he made a joke on something that by law your not allowed to joke about because you can be trying to trick people into giving you money.

    Obvious joke is obvious.

Also, many of the SEC's regulations are really stupid. You can go to prison for insider trading for saying gossip like "I heard Mike is quitting" if someone who hears it has stock in the company and Mike is listed publically as a VP or lead engineer or something. They could liquidate their holdings and short the stock to make a considerable percentage if it turns out to be true -- but someone who didn't hear that sentence can't.

Sharing office gossip == insider trading. Venting about your boss, telling someone you're quitting, talking about product release dates, ... basically talking about the company at all could be considered insider trading and could cost you a small fortune in fines or years of your life. (And no, there is no kickback or payment for the information required. "Insider trading" is only about trading based on non-publically available information.)

There are a lot more legal pitfalls just as capricious as this one, too.
